What is Labor and Employment Law?
Labor is primarily issues involving unions and health and welfare (medical insurance) funds. This includes but is not limited to: organization and unionization of a workplace; negotiations related to the creation, modification and renewal of a collective bargaining agreement (CBA); proceedings before the National Labor Relations Board and relevant state labor agency; and arbitration of disputes between the employer, the union and the employees/union members.
Employment is primarily issues involving individual employees. This includes but is not limited to: statutory issues under federal, state and local law (e.g. Title VII, the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), the Age Discrimination in Employment Act, the Pregnancy Discrimination Act, COBRA, ERISA, Worker Adjustment and Retraining Notification Act (WARN), NYS Executive Law, whistleblower statute, False Claims Act (Qui Tam), retaliation); and Fair Labor Standards Act.
